USB is not mentioned as MQA capable in the specs, or my eyesight is failing me. Can you please clarify? Thanks.

Yes, the USB is MQA capable. I'm using the X16 with Tidal MQA over USB and it works great.

Would using a MacBook Pro, the Tidal App, and a USB connection with this DAC allow for the highest resolution possible?

Yes, especially with their MQA and various 96kHz or 192kHz tracks. I have Tidal settings set to exclusive mode and passthrough MQA as well.

Your issue would be with your retailer (they, in turn, would deal with Gustard, as would be their right), there is usually a given period (2 years in Europe) and disputes can be lodged through small claims for a nominal fee, where they need to interact (dispute the claim or mediate) within a set period after lodging the claim (2 weeks where I'm from) or else the court will automatically side with you. You'll have to look into consumer rights where you are from but most retailers/companies, in my experience, will sort something out before things escalate. I've no legal background or such, I just know you have rights - sorry if that isn't the clarity you were seeking & good luck resolving your issue.
